Cashcall is shady?*

Cashcall seems to follow the 'rules', but their practices if you miss a payment are definitely shady. (Not to mention they put the interest rate in the commercials in very fine print, and dont tell you the rate when making the loan). Either way, my mother got sucked into this loan; she was hoping to consolidate smaller bills into one. Due to an emergency this month, she was forced to miss a payment. The people at Cashcall told her they would give her til the 18th to pay it. Since that phone call, they tried to force payment on her account two times, which of course was rejected. Now her bank is charging her insufficient funds each returned, plus its Wells Fargo and they charge an additional $5 a day for being negative. So because of them, she now won't have enough of the money to pay by the 18th. She spoke to another agent two days ago, and explained this to her. She told the lady she would have to do it on the first of the month now and make a double payment. Today, she received two emails. One saying they were going to process payment today, and the other saying that they have been unable to reach her and to please call. I know these can be generic, but by first telling her she had til the 18th, and now having it down as the first, does this not constitute as a verbal agreement? I know some can be honored by law. If so, they shouldnt be trying to take the money out before specified. I was looking this up, and I read someones comment that you can ask Cashcall to not take the money out of your account automatically. Is this true? My mother understands she signed the agreement and owes the loan, but it's hard to catch up when theres an emergency and then they are causing over a hundred in bank charges

Answers:

1) if you have n e thing in Writing it will help.. sadly those Bastards that loan Money like Cash Call, will try everything Verbaly, and they usually have the advantage over someone else.. if n e thing try to get a bank loan or see if someone can lend you money, also try to pay Cashcall aas fast as you can, and work something out with your bank.... oooh and one last tihng.. Switch banks! cuz that sucks that they charge you daily..

2) Have your Mom contact her bank and ask her bank not to let charges go through. They will hold the charges and not get let them go through and that way she will not be charged for returned items. The only problem is they will not let any automatic withdrawel go through so she has to keep that in mind for temporarily it would be a solution as cashcall will continue to try to put the charge through and cause numerous overdraft fees.

3) Cash call is my lender as well. earlier this year i had a problem with them going into my account. if you no longer want thenm taking funds outta your accouct, write them a letter, stating that you want to pay manually. by law, Cash call can't withdraw outta your account. oh yeh, Cash call is known for reporting to the THREE major credit bureaus, only if you are LATE. so please don't be 30 or more days late or you will get a bad credit rating.
