I answered a complaint filed against me, now the creditor has motioned for a summary judgment, what do I do?*
I am being sued by a Credit Union for a unpaid credit card. I am working with other creditors to pay them in installment.This one will not answer my calls. I contacted several attorneys, called the CCC of Nevada. Called Nevada Bar for referral, called Legal Aid. They all say it is commendable that I am trying to pay everyone back and that some creditors are willing to work with me. This one is not! Attorneys said go bankrupt. No one will help me through the maze of court filings.They will help me go Bankrupt. I don't want to go Bk. I have only this one creditor that is suing me and won't settle. Attorneys said the creditor will win and when they have their judgment, they will wipe out my bank account. Our pension is only safe until we put it in the bank. What about rent food etc. The attorneys said, creditors don't care, so go live with your kids or file BK. I am trying to get a job (was in Real Estate) at 62 it is hard. Why won't anyone help me through the court maze of filings etc

1) I think they have given you all the free help they can. You can either file bankruptcy or just show up in court and watch the credit union win the judgment. You owe the money and obviously defaulted on your agreement. They are going to win. They don't have to work with you.
2) Unfortunately this doesn't sound real promising, especially if it's the credit union and not a collection agency suing you since they probably have all the records of this account. What BDancer failed to mention is that you can go to court and ask the judge to order a payment plan that you can afford. If you have been trying to settle this debt on your own you can use that to your advantage.
