Anyone else having problems with Equifax?*
As I posted earlier I am having some problems with items that are not mine popping up on my credit report. Turns out there is some one with the same first middle and last name and birth date if you can believe it.
Transunion and experian are both being really good about it (especially transunion)
BUT equifax is not even responding to my complaints at all. All they are doing is "verifying" the information. I have sent them letter after letter. I have sent them documentation from the other bureaus and no response. I have proof that they have my letters. This has been going on for months now.
Any advice?
Answers:
1) Have you called them? Do you have any friends who are attorneys? Everything should be based on your social security number so I would find out what their credit check system is online (truecredit.com, etc.) and go on and dispute the charges that aren't mine. Maybe that would help? It won't solve the issue long term but it should get the ball rolling anyway. How frustrating!
2) Here's a template I made for dealing with removing items on a credit report that do not belong to you and the credit bureau comes back and validates the debt anyway. ================== Send a letter via Certified Mail + Return Receipt to Equifax (include a photocopy of your driver's license and circle your date of birth and your middle name). State the following: Notice of Fair Credit Reporting Act Violation This alleged debt from [enter name] that was recently validated is not mine. This frivolous validation of a debt that does not belong to me has damaged my credit rating. Per the Fair Credit Reporting Act, I am requesting: - a copy of the signed contract of this alleged debt - validation of the "Date of Delinquency" for this alleged debt - validation of the "Date of Last Activity" for this alleged debt - a copy of the written communication between Equifax and [enter name] that led to validation of this alleged debt This letter has been sent via Certified Mail + Return Receipt and is being time stamped. If I do not receive a response within 30 days of receipt, I will interpret this as a refusal to document the validation of this alleged debt and I will have no choice but to take legal action per my rights under Fair Credit Reporting Act. Next: Send a letter via Certified Mail + Return Receipt to whatever company or debt collector has placed the negative item on your credit file, stating: Your firm has damaged my credit rating with your posting of damaging info on my credit file for a debt that I do not owe. Per the Fair Debt Collection Practices Act, I am requesting: - a copy of the original signed contract for this alleged debt - validation of the "Date of Delinquency" for this alleged debt - validation of the "Date of Last Activity" for this alleged debt Either validate this alleged debt or remove it from my credit files. If this notation is not removed, I will have no choice by to take legal action per my rights under the Fair Debt Collection Practices Act. I also file reports with the Attorney General [enter state] if this bogus notation is not removed from my credit file ====================== If this does not work, your only recourse is to contact an attorney and sue for Fair Credit Reporting Act violations
