Haven't had this cell phone in 4+ years, now credit agency is contacting.?*
My husband had suncom 4+ years ago, before we ever even met. He paid it off, and hasn't heard anything since. Now as of today, he owes $650!!! The credit agency will settle for $250 which it looks like were going to have to do, if t-mobile (who now owns suncom) wont do anything.
Has anyone ever been through something like this? He hasn't heard anything out of these people in over 4 years and it's strange that now he owes money to them. What sucks is after 4 years he no longer has any receipts to prove things were paid off.
We are going to contact t-mobile but I'm sure that conversation isn't going to go well, and was just looking for some help on here.
Thanks
thanks for that info, but can you give me the site where you found that information?
Also, t-mobile has NO information on my hurband, it doesnt show him even in their system.
Answers:
1) Cell phone account statute of limitations is only 2 years... Per the Fair Debt Collection Practices Act, you can send them a "cease communications" letter and that will be all that you need to do. Per this law they must cease collection activity. Send the collection agency a letter via Certified Mail + Return Receipt (NOT regular mail) stating: Per the Fair Debt Collection Practices Act, cease all communications with me about this alleged debt. This letter has been mailed via Certified Mail with Return Receipt. Receipt of this letter is being officially time stamped.
2) Not sure what state your in but the statue of limitations is 4 years double check. You need them to prove that you owe the money. Do not send any money until then if you do you will have started the debt again and the limitations will no longer apply. Do a search for Debt Validation Letters and modify it to fit your situation. Try not to be to harsh just direct and ask for Validation of Debt not your address they have that. Hope this helps!!
